• Response policy for delete request

  1. In case we can not determine the notified infringement of right
     When a person who claims intellectual property rights such as copyrights, portrait rights, trademark rights, or human rights such as defamation or privacy has been infringed has reported infringement information and request transmission prevention measures, we will check tha tatus of infringement information. However in some cases, we may not able to determine whether or not the content of the notified infringement information. In such a case, we will take the following measures:
     1. Notify the contributor of the image or comment on the infringement information that the request for transmission prevention measures has been received regarding the posting, and set a deadline of 7 days (2 days only in case of infringement of honor etc. by private sexual images) Establish and inquire about whether you agree to take transmission prevention measures for posting.
     2. If the contributor does not respond by the deadline saying "I do not agree to take transmission prevention measures", the Company will take transmission prevention measures.
     3. If a contributor responds that he / she does not agree to take transmission prevention measures, we confirm whether or not the Company violates the terms of service or guidelines (hereinafter referred to as terms of service) of the Photonary service. If it cannot be determined that it violates the Terms , etc., we will not be able to take transmission prevention measures in a situation where we cannot confirm the infringement of rights, so we will notify the applicant to that effect.
  2. When it can be determined that the posted content may be infringed or infringed on the law
     In order to prevent the spread of damage if there is a publication that infringes on the privacy of a person, or it is found that the copyrighted work of another person has been published without permission, or there is a publication that may violate other laws , You need to take immediate measures to prevent transmission. In such a case, we will take the following measures:
     1. We will take transmission prevention measures for posting and notify the poster (warning) that we have taken transmission prevention measures.
     2. If it is determined that the usage is malicious, the service may be stopped.

• Voluntary deletion policy

  As described in Section 2 of the Response Policy for Deletion Requests, content that appears to be in conflict with the law is deemed to be in conflict with the Photonary Terms of Use and will be deleted. In addition, if it is determined to be contrary to public order and morals, it will be deleted as well.

The governing language of this Agreement shall be Japanese. If a translation is created for reference, only the Japanese original shall have the effect of a contract and such translation shall have no effect.
